Photography Ts and Cs

TERMS

This agreement is between Photographer Name, hereinafter referred to as the “Photographer”, and the signers of this portrait photography agreement, hereinafter referred to as the “Clients”, collectively referred to as the “Parties”, with the portrait session detailed below.

The package list and price list and/or documents attached to this contract are integral parts of this document. The contract terms, agreement, and price list are the only legally binding documents between the Parties.

Overview: This agreement contains the entire understanding between the Photographer and the Client. It supersedes all prior and simultaneous agreements between the Parties. The only way to add or change this agreement is to do so in writing, signed by all the Parties. If the Parties want to waive one provision of this agreement, that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.

Change of date or venue: The Photographer must be notified immediately of any changes in schedule or location, at least one week prior to the scheduled date of event. Notification of any changes can be made by email for documentation. If an email is sent, a confirmation of receipt must be sent back by the Photographer in writing or via email. It is the client’s responsibility to confirm all arrangements at least 7-10 days prior to the event. In the event of change of address or contact information (time, etc.) as listed, you must notify the Photographer.

The Photographer kindly asks that the Client get in touch with the Photographer two weeks prior to the date of the event in order to touch base and go over last minute details. The Photographer will make every effort to contact the Client, but it is the Client’s responsibility to contact the Photographer to confirm all events and times.

Retainer: A Retainer Fee Amount is required for all portrait sessions.

This is a non-refundable retainer. In the event of cancellation, the retainer paid is non-refundable. It shall be liquidated for damages to the photographer in the event of a cancellation or breach of contract by the Client. No date is reserved until a retainer is received. The retainer shall be applied towards the total cost of the service to be rendered. The balance of the complete package price must be paid before or on the day of event. If final payment is not received, the Photographer will not be expected to attend said event. Additional custom orders (reprints, enlargements, albums) must be paid in full at the time of order.

Cancellation: There shall be no refund of the retainer after the signing of the Agreement and the reservation of the photography date. If the event is cancelled within two weeks of the date, the client shall pay the balance of the contract due to the high probability that the Photographer will not be able to further book that date. Once a balance is paid, it is non-refundable. Any other arrangements shall be discussed between the Clients and the Photographer. All arrangements will be put in writing. Cancellation must be in writing even if a phone call was made to inform the Photographer of the cancellation.

Failure to perform: The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. Due to the limited and subjective nature of the event, the Photographer cannot be held responsible for requested photographs not taken or missed, lack of coverage resulting from weather conditions, or schedule complications caused by but not limited to, anyone in or at the event. The Photographer is not responsible for lost photo opportunities due to other cameras or flashes, the lateness of the clients or other principles. The Photographer is not responsible for the lack of coverage due to weather conditions, scheduling complications due to lateness of individuals, rules and restrictions of venue, or the rendering of decorations of the location. It is acknowledged that any lists submitted to the Photographer will be used for organisational purposes only and in no way represent photography that will be produced. The Photographer will do their best to fulfil all requests but cannot guarantee all images will be delivered. The Photographer recommends that the Client point out important individuals for informal or candid photographs to the photographer during portrait shooting that they wish to have photographed. The Photographer is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to the Photographer.

Clients are responsible for all location fees and permits.

Copyright: Title (possession) of and copyright to all products shall remain with the Photographer until the client has paid in full. All photos are copyrighted. The negatives and or digital images (hereinafter collectively the “images”) created by the Photographer and/or subcontractor(s) remain the property of the Photographer.Every effort is to be made by the parties involved to credit the photographer.

Permission is hereby granted to the Photographer to use any images created under this contract for professional samples, displays, internet website pages, advertising, exhibitions, contests, and any other purpose. Some parents do not want their child’s face on the internet- it is therefore important for parents to share this request and allow the photographer to share images that do not include photos that disclose identities. 

The Photographer retains the copyright to all images produced by the Photographer and/or the Photographer’s subcontractors.

Expenses: Travel expenses such as parking, shipping, or destination fees must be reimbursed to the Photographer and will be added to the balance due after the event. Travel fees are pre-determined and will be set out in the initial payment total. Clients are responsible for all location fees and permits.

Creative License: Images are edited at the Photographer’s discretion, and delivered prints may not include all images shot. The Photographer reserves the creative rights to edit and release only those images deemed creditable as professional in quality and within the photographer’s artistic standards.

Force majeure: If the Photographer or its assigns cannot perform this Agreement due to a fire, casualty, strike or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, fire, terrorism or other causes beyond the control of the parties, then the Photographer shall return any moneys paid by the Client, less retainer fee and expenses, but shall have no further liability with respect to the Agreement. This limitation of liability shall also apply in the event that photographic materials are damaged, lost through camera malfunction, compact flash card malfunction, or otherwise lost or damaged without the fault on the part of the Photographer. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.

This is a contract for personal photography services to be provided by the Photographer and/or individuals subcontracted to do work for the Photographer. The Parties agree to the above and below terms and conditions, and acknowledge that they have received, read, and understand the Photographer’s agreed price for this shoot.

Ts and Cs

-To offer practical and emotional support but not advice, to women and birthing people and/or parents, empowering them in their own choices. 

-To recognise that women’s and birthing peoples’ choices are valid and that the birthing person assumes responsibility for the birth, parenting style or feeding method they feel is right for them and their baby. All final decisions come from the birthing person. 

-The role is to maintain the highest level of care and support possible. To strive to be sensitive, nurturing, empathic, nonjudgmental, evidence-based, flexible, reliable, well-organised, practical, and protective of the birthing person and their family’s environment.

-Does not perform clinical, midwifery or medical tasks, diagnose medical conditions or give medical advice, whilst working as a doula or holistic pelvic support specialist.

-Does not contravene Article 45 of the Nurse and Midwifery Order.

-Will signpost clients to other appropriate resources/professionals should the client have needs beyond the scope of their doula or holistic pelvic health practitioner role. 

-Will accurately represent their doula education and pelvic health and experience and will not mislead other doulas, clients, health professionals or other birth professionals at any time.

-Will be honest and show integrity and respect at all times towards clients, doula colleagues and other professionals.

-For doula services the full payment by week 36 to provide the services. It’s important to note that I am only available for one or two births per month and this is my main source of income due to the nature of being on call. This is non-refundable due to the nature of the work. 

-Payments to arrive in line with the agreement made at the beginning of our time together. I may charge interest on any balance outstanding.

-Postpartum visits must exist in a format that works for the vibe of supporting postnatally. If you remain in hospital after birth- I will tend to you there until you are home. First visit- in visiting hours the next day. Second visit- second day. Third visit- third day. Fourth visit- fourth day. Fifth Visit- fifth day or sixth day. Following visits in line with what we feel suits. If you choose not to have the immediate visit, for example, this visit is forfeited and so on. 

-If clients want further clarification or discussion around the unfolding journey- they must reach out immediately so we can discuss and rectify. 

-At no point do clients use social media or other outlets to discuss the container with any personal

-Clients understand that this work is not a substitute for medical support and therefore will seek medical support as and when they feel necessary

-You make all choices and decisions. Or medical professionals. Outcomes are directly your responsibility. 

-Holistic Pelvic floor therapy is a mentorship model utilising the spiritual, emotional and physical elements within the space- if you require further clarification or support it is your responsibility to seek medical guidance. 

Clients take full responsibility for the above ts and cs when committing financially to a container. 

Consultation forms

☽ In order to work with Naomi Gale you must complete a client form

☽ Identity data: may include your first name, last name, marital status, date of birth and gender

☽ Contact data: may include your home address, email address and telephone numbers

☽ Health data: will include medical and emotional questions which are required before any fertility awareness work or any of the holistic treatments I provide

☽ Sensitive data: Naomi Gale does not collect any sensitive data about you which refers to data around race, ethnicity, religious or philosophical beliefs, sexual orientation. We may discuss sexual orientation with regards to FAM and if the client wishes to share their sex life with Naomi Gale this is at their own discretion for the purposes of FAM

☽ Financial data: is collected through Stripe, Paypal or BACS

☽ Transaction data: may include details about payments made for treatments

☽ Your personal data will be stored in a password protected computer and in a locked cabinet in Naomi Gale’s home. It will only be accessible to Naomi Gale

☽ Your information is never shared with any third-party companies

☽ Your email will be added to Naomi Gale’s email list but you can unsubscribe at any time. You will only be contacted about matters relating to Naomi Gale.

Data Retention

☽ By law Naomi Gale is required to keep basic information about clients which includes the above for 6 years after a client ceases being a client for tax purposes

☽ Medical Malpractice requests that we keep consultation files on record for 7 years after treatment with Naomi Gale. After this they will be destroyed

☽ Naomi Gale only retains your personal data for as long as necessary to fulfil the purposes it has been collected for which includes for the purposes of satisfying any legal, accounting or medical requirements

Record Keeping

☽ Client forms are kept on a password protected computer within a password protected account. Paper print-outs are then kept in a folder in a locked filing cabinet in Naomi Gale’s home

☽ Such files are not viewed or accessible by anyone other than Naomi Gale unless this discussion takes place and you would like to work with a reccomended practitioner or you would like to use the information from your FAM forms or charts for a medical practitioner such as your gp

☽ You can view your files at any time

Protecting your privacy

☽ This website has been created by Naomi Gale and is only accessible by Naomi as there is a commitment to protecting and securing clients’ personal information.

Disclosing Information

☽ Clients’ personal information will not be sold, distributed or leased to 3rd parties unless we have the clients’ permission or are required by law to share such information.
